We have extensive experience representing stakeholders in the development and redevelopment of large road, rail, and airport projects, and other public infrastructure, including stadiums, student housing, water, parking facilities, and mixed-use projects. Our team has been shortlisted twice in the “Best Legal Advisor” category by P3 Bulletin, which recognizes innovation and excellence in the field of P3.
Our P3 experience unites the capabilities of our infrastructure, construction, real estate, project finance, public finance, environmental, energy, insurance, and tax practices to provide holistic counsel across the wide range of issues encountered in connection with the development, financing, construction, operation and maintenance of P3 projects.
Understanding the complexities of risk allocation that drive successful P3s, our lawyers consistently add “out of the box” solutions to address the challenging issues unique to these dynamic projects.
Members of our P3 team have represented a wide range of clients, including public authorities, sponsor entities, and design-build and operation and maintenance contractor entities on P3 projects. Recent experience includes:
- Represented the design-build joint venture engaged by the sponsor entity for the $4 billion redevelopment of the LaGuardia Airport Central Terminal Building, involving the overhaul of one of New York’s busiest airports.
- Advised an equity member of a shortlisted proponent for the $2.1 billion I-10 Mobile River Bridge and Bayway Widening P3 in Alabama. The 11-mile revenue-risk project involves a new six-lane cable-stayed bridge, replacement of the existing interstate bayway, and five interchange modifications.
- Represented the design-build joint venture through commercial and financial close of the $2.3 billion I-4 Ultimate in Central Florida. This availability-payment P3 will add four express lanes with dynamic toll pricing (two in each direction), rebuild 15 major interchanges, and add, replace or widen 140 bridges.
- Advised a governmental entity on structuring and procuring a proposed P3 for new and expanded education facilities in conjunction with commercial development on the existing campus, to help fund capital costs and elevate private economic activity.
- Advised the design-build joint venture to a shortlisted proponent pursuing a P3 for a highly-sophisticated electronic train system at Los Angeles International Airport known as the Automated People Mover.
- Advised an operation and maintenance provider as part of a consortium in pursuit of a full concession of the water and wastewater systems of a Northeastern municipality.
- Represented the EPC contractor for a shortlisted consortium pursuing Maryland’s 16-mile Purple Line, a 21-station light rail project connecting with four branches of the Metrorail system, Amtrak, and all three MARC commuter rail lines.
- Advised the facilities management firm of a shortlisted proponent for a P3 for multiple educational buildings with a combined construction value of approximately $450 million.
- Advised design-builder of a new terminal at a large New York City airport as part of a consortium appointed to design, build, finance, operate and maintain the terminal.
