Real estate clients are looking for counsel with thorough experience in various areas of condominium and cooperative practice of law, ranging from the regulatory process, to the preparation of the documents converting properties to fee or leasehold condominium or cooperative ownership, to the multitude of matters faced by a condominium board of managers or a co-op board of directors in governing the owners of condominium or co-op units, to strategizing and implementing or defending litigation. Clients turn to Alan for his deeply rooted and trusted counsel and advice in condominiums and co-ops, and their underlying fields of state securities law, business corporation law, real property law and tax law.
Over the years, Alan has represented major developers and building owners in registrations of residential, commercial, and mixed-use cooperative and condominium offering plans for hundreds of newly constructed, loft-rehab and rental buildings throughout the New York City metropolitan area, as well as owners and developers of non-public conversions of bulk residential and/or commercial properties to condominium ownership. His extensive practice includes representation of cooperative and condominium boards, institutional lenders, individual sellers, buyers, landlords and tenants, and in the areas of work-outs, bulk sales and acquisitions, auction sales, and co-op mortgage refinancings.
Alan was a former assistant attorney general in the predecessor to the current Real Estate Finance Bureau of the New York State Department of Law, where he reviewed and passed upon registration of cooperative and condominium offering plans, conducted civil and criminal investigations, prosecuted civil and criminal violations of the Martin Act (the state's securities law), and handled appeals of lower court decisions to the Court of Appeals (the state's highest court). While in private practice, Alan served as consultant in the initial promulgation of today's attorney general's cooperative and condominium regulations.
Alan chaired the cooperative and condominium departments at several firms where he authored hundreds of cooperative and condominium and cooperative offering plans. These include the innovative and pioneering plan for Olympic Tower Condominium (641 Fifth Avenue), the first major mixed-use residential, office, and retail new construction offering plan that led to what is known as the lollipop condominium. Other prominent Manhattan conversions included the Ansonia (2102-20115 Broadway), the Sovereign (425 East 58th Street), 24 Fifth Avenue, the Broadmoor (235 West 102nd Street), and the Westbury Hotel (15 East 69th Street). In Brooklyn, they included the former Board of Education building (110 Livingston Street).
