Brenda serves as a counselor, litigator, and noted speaker on legal issues involving landowners, developers, general contractors, and design professionals. She has experience counseling clients on risk management best practices; drafting critical documents, contracts, and procedures; and effectively resolving disputes.
For nearly three decades, Brenda has helped clients resolve complex construction disputes through negotiation, mediation, and—when necessary—arbitration and litigation. She has substantial experience and knowledge on dispute resolution, having a background as a mediator and professor on negotiation and mediation.
Brenda has worked with clients on projects in California, nationwide, and internationally. Brenda assists developers, construction companies, and design professionals with issues such as course-of-construction disputes, claims of construction defects, and insurance issues. She has substantial experience counseling clients on building envelope, water infiltration, and mold-related claims. Brenda assists clients with mechanic’s liens, payment disputes, bid protests, and contract and delay/acceleration claims on both public and private projects.
Additionally, Brenda advises clients utilizing innovative project delivery systems, including EPC, design-build, and public-private partnerships (P3). She has represented clients on projects involving renewable energy, airport improvements, surface transportation infrastructure, health care, and multifamily housing. Brenda has provided advice on contract terms, compliance issues, and the resolution of disputes arising out of the performance of complex design and construction contracts.
